Terms of Service

Section 1 — Service Description and Scope

1.1 Provider

These Terms of Service (“Terms”) govern your use of the web accessibility remediation and monitoring services (“Services”) provided by Fix47, a sole trader business operated by Carlo Anselmi, 124 City Road, London EC1V 2NX, United Kingdom, ICO Registration ZC137959 (“Fix47”, “we”, “us”). By purchasing our Services you agree to these Terms.

1.2 Setup Service — One-Time

The one-time Setup Service (“Setup”) consists of:

  • An automated and semi-automated accessibility audit of your website using axe-core (90+ WCAG rules) and supplementary tooling;
  • Identification and prioritisation of WCAG 2.2 AA violations detectable by automated scanning;
  • Remediation of violations so identified, applied via code changes to your website;
  • Delivery of a written Fix47 Accessibility Scan Report listing violations found and remediation actions taken.

1.3 Membership — Ongoing

The Membership subscription (“Membership”) consists of:

  • Monthly or annual re-scanning of your website for new or regressed WCAG 2.2 AA violations detectable by automated tools;
  • Remediation of new violations identified during re-scans, within the response times stated in your order confirmation;
  • Access to your Fix47 status portal showing scan history and open items;
  • A written remediation queue maintained by Fix47 listing all items scheduled, in progress, or completed.

1.4 What is NOT included

The Services expressly do not include:

  • Manual expert accessibility audit or full WCAG 2.2 AA conformance certification by a human auditor;
  • Remediation of violations that are not detectable by automated scanning tools (automated tools identify approximately 30–40% of WCAG 2.2 AA criteria; the remaining criteria require manual testing);
  • Legal advice, legal representation, or any opinion on your exposure or liability under the Americans with Disabilities Act (ADA), UK Equality Act 2010, European Accessibility Act 2019/882, or any other statute;
  • Defence of, or any contribution to the costs of, any legal proceeding, demand letter, settlement, or regulatory action;
  • Guarantees of full legal compliance with any accessibility law;
  • Modifications to third-party platforms, plugins, or widgets whose source code is not accessible to Fix47 via the credentials you provide.

1.5 Automated scanning scope

Fix47 uses automated scanning tools. Automated tools cannot detect all accessibility barriers. Fix47 does not warrant that remediation under these Terms will result in full WCAG 2.2 AA conformance as assessed by a qualified human auditor, nor that it will prevent all legal claims under any accessibility statute.

Section 2 — Pricing, Fees, and Payment

2.1 Setup fee

The one-time Setup fee is $750 USD (or currency equivalent shown at checkout). The Setup fee is due and charged at the time of purchase.

2.2 Membership fee

The Membership fee is $149 USD per month (monthly plan) or $1,490 USD per year (annual plan), as selected at checkout. The first Membership payment is charged at the time of purchase, together with the Setup fee.

2.3 Payment processing

All payments are processed by Stripe, Inc. in accordance with Stripe's terms of service and privacy policy. Fix47 does not store your card details.

2.4 Taxes

Prices are shown exclusive of VAT and any applicable sales tax. Customers in VAT jurisdictions (including the UK and EU) may be charged VAT at the applicable rate. UK and EU customers: VAT may be added at checkout in accordance with applicable law.

Section 3 — Fix47 Service Guarantee

Every Fix47 Membership includes a three-part service guarantee. It is a commitment about Fix47’s own work and fees only. It pays out solely as a refund of Fix47’s own Setup fee for Fix47’s own non-performance, and never on the occurrence of any external event such as a demand letter, lawsuit, or regulatory action — see Section 3.4.

3.1 The three-part guarantee

  • (a) Setup fixed or refunded. If Fix47 fails to remediate the WCAG 2.2 AA violations identified in your written Fix47 Accessibility Scan Report after receiving full site-access credentials, Fix47 will refund your one-time Setup fee ($750).
  • (b) Cancel anytime. You may cancel your Membership subscription at any time, in one click, via the Stripe Customer Portal. There is no cancellation fee and no obligation to continue.
  • (c) New violations fixed free.While your Membership subscription is active, any new in-scope WCAG 2.2 AA violation that Fix47’s automated monitoring detects is re-remediated at no additional charge.

3.2 Scope and exclusions

  • (a) Setup fee after commencement. The one-time Setup fee ($750) is non-refundable once Fix47 has commenced remediation work, confirmed in writing (email) when Fix47 begins the audit or site-access phase. The refund in 3.1(a) applies where Fix47 has received access but fails to remediate the identified violations.
  • (b) Automated-scan coverage.The guarantee applies to violations identified in a written Fix47 Accessibility Scan Report by automated tooling (approximately 30–40% of WCAG 2.2 AA criteria). Violations detectable only by manual audit are outside its scope.
  • (c) Third-party or platform violations. Violations arising in third-party widgets, embedded iframes, or platforms to which Fix47 does not have remediation access are excluded.

3.3 Setup-refund claim procedure

To claim the Setup-fee refund under 3.1(a) you must:

  • email hello@fix47.com identifying the violations from your written Fix47 Accessibility Scan Report that were not remediated; and
  • allow Fix47 a reasonable opportunity to complete the remediation before a refund is issued.

Fix47 will acknowledge your claim within 3 business days and process any eligible Setup-fee refund within 14 business days of confirming the claim.

3.4 Guarantee is not indemnity, insurance, or legal protection

THIS GUARANTEE IS A SERVICE-FEE REFUND ONLY. IT DOES NOT CONSTITUTE:

  • Legal indemnity or indemnification against any claim;
  • A contract of insurance or any insurance product regulated under the Financial Services and Markets Act 2000 (FSMA 2000) or any other law;
  • Any assumption of liability by Fix47 for legal proceedings, attorney fees, settlement costs, damages, or any third-party costs;
  • A warranty of legal compliance with the ADA, UK Equality Act 2010, European Accessibility Act, or any other statute;
  • Any guarantee that your website will not be the subject of legal proceedings.

Section 4 — Automatic Renewal and Cancellation

4.1 Automatic renewal

YOUR MEMBERSHIP SUBSCRIPTION RENEWS AUTOMATICALLY. By purchasing a Membership, you expressly agree that:

  • Monthly plan: your subscription renews automatically at $149/month on the same calendar date each month until you cancel;
  • Annual plan: your subscription renews automatically at $1,490/year on the same calendar date each year until you cancel.

4.2 Renewal reminder — annual plan

For annual plans, Fix47 will send you a renewal reminder email approximately 30 days before your renewal date, and a second reminder approximately 7 days before your renewal date. These reminders will include the renewal amount, the renewal date, and a direct link to cancel.

4.3 How to cancel

You may cancel your Membership subscription at any time by:

  • Logging into your Fix47 status portal and clicking “Cancel Subscription” (no phone call, no form required); or
  • Emailing hello@fix47.com with your account email address and a clear cancellation request.

Cancellation via the status portal is the same channel as signup (online) in compliance with 16 CFR §425.4(c) (FTC Click-to-Cancel Rule).

4.4 Cancellation deadline

To avoid being charged for the next billing period, you must cancel at least 24 hours before your renewal date. Cancellations made within 24 hours of a renewal date may result in one additional charge; that charge will be the last charge and your subscription will not renew thereafter.

4.5 Effect of cancellation

Cancellation takes effect at the end of the current billing period. You retain access to your Fix47 status portal and scan history until the end of the paid period. Fix47 does not charge cancellation fees or penalties.

4.6 Refunds on cancellation

Cancellation of a Membership does not entitle you to a refund of fees already paid for the current billing period, except:

  • where you are a UK or EU consumer exercising your statutory right of withdrawal within the 14-day cooling-off period as set out in Section 5; or
  • where a refund is due under the Service Guarantee in Section 3; or
  • as required by mandatory applicable law.

4.7 Record retention

Fix47 retains records of your subscription consent, renewal history, and cancellation for a minimum of 3 years in compliance with California Automatic Renewal Law (Cal. Bus. & Prof. Code §17606) and FTC record-keeping guidance.

Section 5 — UK and EU Statutory Right of Withdrawal

5.1 14-day right of withdrawal — who it applies to

If you are a consumer (as defined in the Consumer Rights Directive 2011/83/EU or the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134) purchasing Fix47 Services as a distance contract, you have a statutory right to withdraw from the contract without giving any reason within 14 days of the date of purchase.

5.2 Withdrawal from the Setup Service — waiver for immediate commencement

The Setup Service is a service contract that Fix47 begins immediately upon receipt of your website access credentials. At checkout, you are asked to confirm the following:

“I request that Fix47 begins remediation work immediately. I understand that once the Setup Service has been fully completed, I will lose my right to withdraw from the Setup Service contract.”

If you provide this confirmation, your 14-day right of withdrawal from the Setup Service contract ceases upon full completion of the Setup remediation, in accordance with:

  • Consumer Rights Directive 2011/83/EU Art. 16(a);
  • UK Consumer Contracts Regulations 2013 SI 2013/3134 Reg. 37.

If the Setup Service has not been fully completed at the time you exercise withdrawal, Fix47 will refund the Setup fee on a pro-rata basis for work not yet performed.

5.3 Withdrawal from the Membership — unconditional 14-day window

You have an unconditional right to withdraw from the Membership subscription contract within 14 days of the subscription start date. If you withdraw within this 14-day period, Fix47 will refund the Membership fee in full. Any pro-rata deduction for Membership services consumed in the period before withdrawal will apply only where you have expressly requested performance to begin before the end of the withdrawal period and acknowledged that withdrawal will reduce your refund accordingly.

5.4 How to exercise your right of withdrawal

To exercise your right of withdrawal, send a clear written statement to:

Subject: “Notice of Withdrawal — [your order reference]”

You may use the following model: “I hereby give notice that I withdraw from my contract for Fix47 services, purchased on [date], order reference [reference].”

Fix47 will acknowledge your withdrawal by email and process any applicable refund within 14 calendar days of receiving your withdrawal notice.

5.5 No detriment to statutory rights

Nothing in these Terms reduces or replaces any statutory rights you have under UK or EU consumer law. The Service Guarantee in Section 3 is a commercial guarantee provided in addition to, and without prejudice to, your statutory rights.

Section 6 — Limitation of Liability and Disclaimer of Warranties

6.1 No warranty of compliance or legal immunity

FIX47 DOES NOT WARRANT THAT:

  • (a) use of the Services will result in your website achieving full conformance with WCAG 2.2 AA or any other accessibility standard as assessed by any manual audit methodology;
  • (b) use of the Services will prevent, reduce, or eliminate the risk of any legal claim, demand letter, lawsuit, regulatory investigation, or enforcement action under the ADA, UK Equality Act 2010, European Accessibility Act 2019/882, or any other law;
  • (c) your website will be free from accessibility violations not detectable by automated scanning tools;
  • (d) remediation actions will not inadvertently introduce other issues or affect the functionality or performance of your website.

6.2 “As is” provision for monitoring and scanning

The monitoring and re-scanning component of the Membership is provided “AS IS.” Automated scanning tools have inherent limitations. Fix47 provides the results of automated scans without warranty as to their completeness, accuracy, or fitness for any particular legal or compliance purpose.

6.3 Liability cap

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIX47'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY, OR OTHERWISE — SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO FIX47 IN THE 12-MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

6.4 Exclusion of consequential damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIX47 SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, exemplary, or consequential loss or damage;
  • Loss of profits, revenue, or business;
  • Loss of data or business opportunity;
  • Costs of legal proceedings, settlements, attorney fees, or fines arising from any third-party claim;
  • Reputational damage.

This exclusion applies regardless of whether Fix47 was advised of the possibility of such damages.

6.5 Exceptions

Nothing in these Terms limits or excludes Fix47's liability for:

  • (a) death or personal injury caused by Fix47's negligence;
  • (b) fraud or fraudulent misrepresentation;
  • (c) any liability that cannot be excluded or limited under applicable law, including rights under the UK Consumer Rights Act 2015.

6.6 Reasonableness of limitations

The liability limitations in this Section reflect a fair allocation of risk between Fix47 and you, taking into account the nature of the Services, the pricing, and that Fix47 is a sole trader SME. They have been assessed for fairness in accordance with the EU Unfair Contract Terms Directive 93/13/EEC Art. 3 and the UK Consumer Rights Act 2015 §62.

Section 7 — No Insurance — Regulatory Disclaimer

7.1 Fix47 is not an insurer

The Service Guarantee described in Section 3 and on the Fix47 website is a contractual service-fee refund commitment. It is NOT:

  • A contract of insurance within the meaning of the Financial Services and Markets Act 2000 (FSMA 2000) or the Regulated Activities Order 2001 (SI 2001/544) Schedule 1;
  • An indemnity against third-party claims;
  • Professional indemnity insurance or public liability insurance;
  • Any insurance product requiring authorisation by the Financial Conduct Authority (FCA) or any other regulator.

7.2 No FCA authorisation

Fix47 is not authorised or regulated by the Financial Conduct Authority for any insurance or investment activity. If you require insurance against ADA or accessibility-related legal claims, you should obtain appropriate professional liability or legal expenses insurance from an FCA-authorised insurer.

7.3 Fix47 is not a law firm

Fix47 provides web accessibility technical remediation services. Fix47 does not provide legal advice, legal representation, or legal opinions. Nothing in these Terms, on the Fix47 website, or in any Fix47 communication constitutes legal advice. You should consult a qualified solicitor or attorney for legal advice regarding your specific situation and legal obligations.

Section 8 — Governing Law and Jurisdiction

8.1 Governing law

These Terms are governed by the laws of England and Wales.

8.2 Jurisdiction — B2B and non-consumer customers

If you are purchasing Fix47 Services in the course of a business (i.e., you are not a “consumer” as defined under applicable law), any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

8.3 Consumer customers — statutory rights preserved

If you are a consumer located in the EU or UK, you retain the right to bring proceedings in the courts of your country of habitual residence, and the mandatory consumer protection laws of your country of habitual residence apply to the extent that they provide you with greater protection than English law. This is without prejudice to any statutory rights under the law applicable pursuant to Rome I Regulation (EC) 593/2008 Art. 6 (consumer contracts) or, for UK consumers, applicable retained UK consumer law.

8.4 Dispute resolution — US customers

For customers located in the United States, Fix47 encourages resolution of disputes through good-faith negotiation. Contact hello@fix47.com in the first instance. Nothing in these Terms prevents you from initiating proceedings in a court of competent jurisdiction.

Section 9 — General

9.1 Entire agreement

These Terms, together with the information provided at checkout and your order confirmation email, constitute the entire agreement between you and Fix47 regarding the Services and supersede all prior representations, agreements, or understandings.

9.2 Amendments

Fix47 may update these Terms from time to time. We will notify you by email at least 30 days before any material change takes effect. Continued use of the Services after the effective date of changes constitutes acceptance of the updated Terms. If you do not accept the changes, you may cancel your Membership before the effective date.

9.3 Severability

If any provision of these Terms is found to be unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.

9.4 Waiver

Failure by Fix47 to enforce any provision of these Terms does not constitute a waiver of that provision or Fix47's right to enforce it in the future.

9.5 Trading name and legal disclosure

Fix47 is a trading name. The legal operator is Carlo Anselmi, sole trader, 124 City Road, London EC1V 2NX, United Kingdom. This disclosure is made in compliance with the UK Business Names Act 1985 (as amended) and Trading Disclosures Regulations 2008 SI 2008/1906 Reg. 6.

Acceptable Use

You agree to use our service only to scan websites you own or have authorisation to scan. You agree not to:

  • Scan websites you do not own or are not authorised to scan
  • Attempt to overload, disrupt, or reverse-engineer our service
  • Use scan results to harass, threaten, or extort website owners
  • Resell or redistribute scan reports without written authorisation

Data Protection

Fix47 processes personal data in accordance with the GDPR (EU) 2016/679, UK GDPR, and CCPA where applicable. Fix47 acts as a data processor on your behalf during the remediation engagement. Scan logs and audit data are retained for a minimum of 2 years from the date of Accessibility Scan Report issuance.

For EU/UK clients, Fix47 will enter into a Data Processing Agreement (DPA) in accordance with GDPR Article 28 upon request. See our Privacy Policy for full details.
