1. Service Description

Fix47 provides automated web accessibility scanning based on WCAG 2.2 AA standards, risk analysis reporting, and optional done-for-you remediation services. Our automated scanner identifies potential accessibility violations but does not constitute a complete manual accessibility audit.

2. Not Legal Advice

Fix47 is not a law firm, does not employ attorneys, and does not provide legal advice. All risk estimates, legal exposure calculations, dollar figures, lawsuit statistics, and case references provided by our scanner and reports are for general informational purposes only. They are generated using automated algorithms based on publicly available data and should not be construed as, or relied upon as, legal counsel, legal opinions, or predictions of specific legal outcomes. You should consult a qualified attorney licensed in your jurisdiction for advice specific to your legal situation.

3. Acceptable Use

You agree to use our service only to scan websites you own or have authorization to scan. You agree not to:

• Use the scanner to perform unauthorized security testing on third-party websites
• Attempt to overload, disrupt, or reverse-engineer our service
• Use scan results to harass, threaten, or extort website owners
• Resell or redistribute scan reports without authorization

4. Remediation Services

For paid remediation services, the following terms apply:

• Scope: Remediation covers the violations identified in the agreed-upon scan report at the time of engagement
• Compliance certification: Refers to WCAG 2.2 AA automated compliance of the agreed scope at the time of delivery
• Post-delivery changes: The client is responsible for maintaining compliance for content, code, or design changes made after delivery
• Payment: 50% due at project start, 50% upon delivery and verification

5. Guarantees

Our Triple Protection Guarantee applies exclusively to paid remediation clients:

• Result Guarantee: If the remediated scope does not pass a WCAG 2.2 AA automated audit, we re-do the work at no additional cost
• Speed Guarantee: 20% discount per business day late beyond the agreed timeline
• Shield Guarantee: If you receive a formal ADA demand letter or lawsuit complaint within 90 days of our completed remediation delivery, and the alleged violations fall within the specific scope of the remediation work we performed, Fix47 will: (a) re-audit and re-remediate the identified violations at no additional cost; (b) provide an updated compliance certificate and timestamped audit trail documenting your proactive remediation efforts, which your legal counsel may use in responding to the demand; (c) provide a template response letter framework (not legal advice) that your attorney can adapt. This guarantee is subject to: (i) you providing written notice to Fix47 within 7 business days of receiving the demand; (ii) you not having modified the remediated code, content, or structure after our delivery; (iii) the alleged violations being within the agreed remediation scope. This guarantee does NOT cover: legal fees, settlements, judgments, fines, penalties, regulatory actions, or any monetary payments to third parties. Fix47 is not a law firm and does not provide legal advice or legal defense services

6. Limitation of Liability

To the maximum extent permitted by law:

• Fix47's total liability shall not exceed the fees paid by the client for the specific service in question
• Fix47 shall not be liable for any indirect, incidental, consequential, or punitive damages
• Fix47 shall not be liable for legal actions, fines, or penalties imposed by third parties, government agencies, or courts
• Our service is provided on a “best efforts” basis using industry-standard tools and methodologies
• Fix47 does not guarantee immunity from lawsuits, regulatory actions, or third-party claims. Compliance remediation reduces risk but cannot eliminate it entirely

7. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
